HB1067 Eviction - Becomes Law July 1st

HB1067 was signed on March 24th.  And will be effective July 1, 2020.

We will notify our members of the changes once the actual laws are written.

HB1067 would streamline the eviction process in South Dakota.  Reducing the debt and possible damages for the tenant and the property owner.

This would change the eviction process as follows:

  • Notice to Quit & Vacate (3 day):  No change to current process
  • Summons & Complaint (4 day):  Notice of Publication would start the same day as first attempt to serve; 4 attempts to serve (6 hours apart), then post it in a conspicuous place & mail.  (NO LONGER PHYSICALLY SERVE)
  • Court Appearance & Judgement:  Judge may not give more than 14 days continuance to tenant.
